1. Service Description

NOTA ("the Service") is an educational application that uses OpenAI's API to provide AI-powered tools. The app transcribes voice recordings, analyzes PDF documents, processes your messages and text inputs, and generates notes, flashcards, quizzes, and responses. The Service is designed to assist users in studying and information management.

2. User Accounts

To access full functionality, including cloud synchronization across devices, you may be required to sign in using your Apple ID or other supported authentication methods. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Subscriptions and Payments

NOTA offers a free tier ("Starter") and premium purchase options ("Nota Pro").

3.1. In-App Purchases

• Subscriptions: The Service offers renewable subscriptions (e.g., Monthly, Yearly). Payment will be charged to your Apple ID account at confirmation of purchase.
• Lifetime Access: A one-time purchase option may be available for lifetime access to premium features.
• Processing: Payments are processed through the Apple App Store (StoreKit) and managed via RevenueCat.
• Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Cancellation: You can manage and cancel your subscriptions by going to your App Store account settings after purchase.

3.2. Free Plan Limitations

Users without a paid subscription are subject to usage limits, which may include but are not limited to:

• Monthly allowance for note creation (e.g., 30 notes/month).
• Recording duration limits per month and per session (e.g., 60 mins/month).
• Limited access to AI features such as Knowledge Check questions.

These limits are subject to change at any time without prior notice.

4. Content and AI Disclaimer

4.1. Generative AI

The Service utilizes artificial intelligence (AI) provided by OpenAI, L.L.C. to generate content. AI systems may occasionally produce incorrect, misleading, or "hallucinated" information.

4.2. Third-Party AI Data Processing

To provide AI-powered features, the Service transmits your content to OpenAI, L.L.C. via their API. All AI-generated responses (transcriptions, notes, flashcards, answers) are produced by OpenAI's models. Specifically:

• Data Sent: Voice recordings (for transcription), PDF document contents, text inputs, messages and chat content, and extracted website text that you choose to process.
• Recipient: OpenAI, L.L.C. (San Francisco, CA, USA), acting as a data processor.
• Purpose: Solely to generate transcriptions, notes, flashcards, quizzes, summaries, and responses to your messages via OpenAI's API.
• Consent: Before any content is sent to OpenAI, you will be asked for explicit consent within the app. You may revoke this consent at any time in the app's settings.

4.3. Ownership

• User Content: You retain all rights to the audio, text, and documents you process through the Service.
• License: By using the Service and consenting to AI data processing, you grant NOTA a non-exclusive license to process your content (including transmitting it to OpenAI, L.L.C.) solely for the purpose of providing the Service features to you.

5. Intellectual Property

The NOTA application, including its interface, graphics, scripts, and code, is the property of the developer and is protected by copyright laws.

6. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

7. Changes to Terms

We reserve the right to modify these terms at any time. Your continued use of the Service following any changes indicates your acceptance of the new Terms of Service.
